Argentina asks U.S. court to block payouts for debt holdouts

NEW YORK (Reuters) - Argentina is urging a U.S. appeals court to reverse an order requiring the country to pay $1.33 billion to creditors who did not participate in its two debt restructurings, a legal case that could have huge ramifications for global debt markets.

Lawyers for Argentina's government said in court papers filed late on Friday that a trial judge was "wrong to ignore the chorus of voices" who opposed his November order on payments to so-called "holdout" creditors.

Those payments, to a court-controlled escrow account, would threaten the service of $24 billion in restructured debt, Argentina's lawyers wrote in papers filed in the 2nd U.S. Circuit Court of Appeals in New York.

"There is no authority permitting a U.S. court to order a sovereign to bring its immune assets into the United States in order to 'turn over' or distribute them to its creditors," lawyers for the Argentine government said in the 69-page filing.

The appeals court is expected to decide next year whether to force Argentina to pay the $1.33 billion to investors in the defaulted debt. The decision could have broad impact on the ability of governments to raise money by selling bonds and on strained countries' response to economic crises.

The case stems from Argentina's $100 billion sovereign debt default 11 years ago. Argentina is trying to avoid paying the holdout creditors, who refused to take part in massive debt restructurings in 2005 and 2010.

About 92 percent of the bonds were restructured, giving holders between 25 cents and 29 cents on the dollar.

But the holdouts, led by Elliot Management Corp affiliate NML Capital Ltd and the Aurelius Capital Management funds, demanded to be paid in full. Argentina calls the holdouts "vultures" and has resisted.

In the papers filed on Friday, Argentina said it is willing to resolve the litigation by reopening the restructuring offer, a move that would require legislative permission but that would likely be rejected by plaintiffs.

"The executive is prepared to once again present to Congress a proposal that definitively treats all holdout creditors on the same terms as participants in the Republic's 2010 exchange offer," the filing says.

"The Republic has already made two debt restructuring offers that plaintiffs chose to reject. It cannot present a proposal that treats holdout creditors better than exchange bondholders."

LONG-RUNNING CASE

In a separate court filing, lawyers for holders of restructured bonds said that holdouts should not be offered better terms than "innocent" bondholders who took part in the swaps. The restructured bondholders include funds managed by Gramercy Financial Group LLC and BlackRock Inc , according to the court papers from the group.

The case has run for years in U.S. courts. Oral arguments before the 2nd Circuit on the appeal are set for February 27, 2013.

A decision against Argentina would deal a setback to President Cristina Fernandez, who is trying to avert the fallout of a potential technical default on tens of billions of dollars of debt.

In a statement late on Friday, an NML spokesman said Argentina was well placed to compensate the holdouts, citing its "more than $43 billion in foreign currency reserves" and billions more in other resources.

"Today's filing by the Republic once again demonstrates Argentina's irrational persistence in evading its contractual obligations and the orders of U.S. courts," said Peter Truell, a spokesman for NML.

There was no immediate reaction comment from Argentina.

Also on Friday, the U.S. government filed a friend-of-the-court brief in support of Argentina's bid for the appeals court to reconsider its October ruling that found Argentina had improperly discriminated against bondholders who did not participate in the debt swaps.

The U.S. government said countries needed leverage to garner broad creditor support for a restructuring. It cited the recent debt exchange in Greece as an example of a situation in which holdouts can threaten orderly bond restructurings.

JUDICIAL REPRIEVE

Following the appeals court's October decision, U.S. District Judge Thomas Griesa in Manhattan on November 21 commanded Argentina to put the payments for the holdouts into escrow by December 15.

But on November 28, the 2nd Circuit gave Argentina a reprieve, saying it did not need to make the escrow payment for now.

The battle has even extended to the 2-1/2 month seizure of the Argentine naval vessel ARA Libertad in Ghana at the request of NML. The boat was freed on December 19 following a ruling by an international admiralty tribunal.

In its court papers, Argentina said that if Griesa's orders were allowed to stand, "we may very well see the end of such restructurings and enter an era where debt crises are irresolvable. This will increase litigation, not reduce it."

The case is NML Capital Ltd et al v. Argentina, 2nd U.S. Circuit Court of Appeals, No. 12-105.

Autism affects approximately 1 in 88 individuals nationwide each year. In New Jersey, this figure increases to 1 in 49. Four northern NJ schools that serve individuals with autism are putting up some impressive numbers in an effort to combat these staggering figures.

On Sunday, May 6, 2012, more than 1,200 cyclists, families, volunteers, donors and sponsors attended the third annual Go the Distance for Autism Bike Event at Bergen Community College. Riders of all ages cycled more than 15,000 miles and raised nearly $1,000,000 to support the educational programs for children and adults with autism at Alpine Learning Group, The EPIC School, Garden Academy and REED Academy.

?Through this wonderful and generous community of parents, teachers, staff, families, friends, and sponsors, the 2012 Go the Distance for Autism Bike Event was a great success and we have made significant progress towards our goals of helping our schools and the cause of autism awareness. Wells Mountain Foundation (WMF) provides support to individuals and families in need of assistance as a result of economic challenges, and in particular, extreme poverty. WMF is 501(c)(3) non-profit and all donations are fully tax deductible.

The WMF Empowerment through Education Scholarship Program has grown from just one scholarship in Ghana in 2005 to 52 WMF Scholars in 2012. WMF scholars hail from over a dozen countries, including Senegal, Ghana, Haiti, Kenya, Uganda, Nigeria, Gambia, Nepal, Rwanda, Sudan, Afghanistan, Pakistan, and Liberia. Eighteen new 2012 WMF Scholars were chosen from over 1600 applications in August of 2012.

The WMF Literacy Program provides books to libraries and programs in Haiti, Ghana, and Nepal. Generally, books are supplied by WMF at no cost. For other non-profit organizations, they offer their services and experience in purchasing and delivering books, sometimes with the organizations only paying for the wholesale cost of the books.

In the area of the arts, the organization has provided art supplies and support in Nepal and Ghana, and this year in Uganda and Kenya.

Because of their affiliation with the YMCA d?Haiti, this year WMF undertook a major program of support after the January 12, 2010 Haiti earthquake. They organized a massive clothing drive with the help of donors, volunteers, and companies here in the United States and ultimately shipped to Haiti twelve containers of clothing and supplies. Gilda's Club Northern New Jersey is an essential complement to medical care for those living with cancer and their families and friends, to help them take control of their lives and learn to live with cancer, whatever the outcome.

Genie Backup Manager Home Edition is a long-established consumer-level backup program that has always impressed me with its clarity, power, and well-chosen range of genuinely useful features. The previous version won our Editors' Choice award, and the latest one comes tantalizingly close to winning it again. The only thing that holds it back is its inability to create a bootable rescue disk on a USB flash drive. It still creates bootable rescue disks only on optical disks, and the era when virtually every computer had an optical drive is over. If you can lie with this one minor limitation, then Genie Backup Manager is a fast, efficient, and beautifully designed application for saving and restoring data.

Interface and Options
Genie Backup Manager's main menu is elegant and informative, with big buttons leading to wizards that perform Backup, Restore, and Disaster Recovery. (The Disaster Recovery wizard creates an emergency recovery disk that you can boot from when disaster strikes.) The Backup wizard lets you create and optionally reuse backup jobs. You create these jobs in a simple interface that lets you choose a backup location either on a local disk, including optical and USB disks, or a network disk, or an FTP location, with fully up-to-date support for secure FTP if needed.

You can choose to backup items from your Windows user "profile," which means that you can select documents from your Documents folder, or media files, or Outlook data files, Windows settings and registry data, and much else. You can also choose specific folders, disks, or Windows-specific locations such as your Libraries and shared folders in a HomeGroup.

Further options let you save your backups in ZIP format or with all files readily accessible. One especially useful feature lets you create archives in the form of executable programs that you can run on computers that don't have Genie Backup Manager installed. This feature reflects the very real possibility that you won't have your backup software available when you need to restore your data in a hurry, or that you sometimes need to restore your backups on someone else's computer.

Backing Up
Genie offers you the standard choice of full or incremental backups, with an option to make your backups "mirror" the source folders, so that files that you delete on the source will also be deleted from the backup. This is a valuable backup type that works in a similar way to file synching services like Dropbox, but it should only be used with the understanding that it won't let you recover deleted files. You can also schedule backups in an intuitive and flexible way. When you've created a backup job, you can modify or reuse it by selecting it from a list in the Backup wizard. You can also modify existing jobs from the app's main menu.

If you choose this program for the non-experts in your family, you can switch to an even simpler interface that offers only the option to create and run a Backup job, or to Restore files. But if you want to use your expertise, you can click unobtrusive "More settings" buttons in the wizard interface and set up e-mail notifications of backup jobs or only of errors and other expert-level features.

Performance
Genie Backup Manager wasn't as speedy as Acronis or NTI, taking 2 minutes 45 seconds to backup an 800 MB folder to a USB3 drive?almost twice the time as Acronis?but speed isn't the most crucial factor in backups. What matters most is reliability and ease of use, because if a backup program isn't easy to use, you're not likely to use it.

I like Genie Backup Manager a lot, and if it could only create emergency boot media on a flash drive, I would happily promote it to share our backup software Editors' Choice with Acronis Backup and Recovery.

Pony back with circus after Christmas kidnap

VIENNA (AP) ? A tiny pony is back at its Austrian circus home more than a week after apparently being kidnapped by a woman who wanted to give her sick daughter a Christmas surprise.

Fridolin the pony, who is only about 2 feet (60 centimeters) tall, went missing from the Vienna Christmas Circus early last week. He was found near a Vienna bus stop Wednesday.

Circus director Adolf Lauenburger told the Austria Press Agency Thursday that a woman called the circus and told officials where to find the pony. She said her daughter wanted a circus pony and she'd taken him to fulfill the girl's wishes for Christmas ? but decided she couldn't keep the animal.

Lauenburger wasn't able to identify the woman. Police were looking into the matter.

Even in same vineyard, different microbes may create variations in wine grapes

Dec. 26, 2012 ? Choosing the perfect wine may soon involve more than just knowing the perfect vintage and chateau. Differences in the microbes present on grapes even in different parts of the same vineyard may contribute to flavor fluctuations in samples of grapes from different tanks, according to research published December 26 in the open access journal PLOS ONE by Mathabatha Setati and colleagues from Stellenbosch University, South Africa.

"In the wine industry, the fungal communities on grapes are especially important. The microbial species present on the berry may contribute to the fermentation process, and therefore the aromatic properties of the resulting wine," the authors explain. For this study, the researchers sampled grapes from different vines in three well-established commercial vineyards, each of which used a different farming system -- organic, traditional or biodynamic- to cultivate the grapes.

Across the three cultivation practices, they found that the same yeast species dominated in all vineyards, but the least treated vineyard had more variety of fungal species than the other two. They also found that within a single vineyard, small differences between vines, such as in temperature or sun exposure, could significantly alter the composition of the fungal community on grape surfaces. Setati adds, "Our findings could help viticulturalists and winemakers plan microharvest better, and implement better wine blending strategies to ensure consistency."

When I am getting ready to perform a home inspection for Desert Sun Home inspections, I always ask the buyer if they have any concerns with the home.

The buyers have already been to the home and checked the home before making an offer.

On this inspection the buyers had a few concerns that they wanted me to pay special attention to.

One of the concerns was the slow moving drains. When they ran water into the sinks and bath tub, then released the water down the drains it would go down really slowly.

I would have found this on my initial inspection, this is a way I check the drains for proper operation.

I went under the home to check out the crawl space and inspect the under home plumbing.

The drain line had been replaced at one time but the plumber either did'nt have the room or they simply did'nt replace the lines for proper flow.

With all the cast iron under the home, this should have been torn out and replaced with all new piping.

This would have allowed the drains to do their job and drain the way the lines were intended to drain.

Maybe Uncle Bob was moonlighting a s a plumber on this day. No one will ever know who did this work.

Charles Durning: 1923-2012

Charles Durning, the real-life war hero and dependable character actor who appeared in The Sting, Tootsie and most recently as Denis Leary's father on the firefighter drama Rescue Me, died Monday in his New York City home. He was 89.

Judith Moss, Durning's friend and agent of more than three decades, said that?the actor died of natural causes on Christmas Eve.

In a rare feat, Durning earned back-to-back supporting actor Oscar nominations in 1983-84. After being signaled out for playing a comically corrupt governor in The Best Little Whorehouse in Texas, he received another nom for his work as?a blundering?Nazi colonel in To Be or Not to Be, starring Mel Brooks and Anne Bancroft.

His other memorable movie roles included playing Dustin Hoffman?s surprised suitor in Sydney Pollack's classic comedy Tootsie (1982). He was a frazzled police lieutenant in Dog Day Afternoon (1975), the U.S. president in Twilight?s Last Gleaming (1977) and a formidable monsignor in Mass Appeal (1984).

He also appeared in two Coen brothers films: The Hudsucker Proxy (1994) and O Brother, Where Art Thou? (2000).

Long active on the stage, Durning won a Tony Award for his portrayal of Big Daddy in the Broadway revival of Cat on a Hot Tin Roof in 1990.

Also that year, he captured a Golden Globe for his role as ?Honey Fitz? Fitzgerald in the miniseries The Kennedys of Massachusetts, based on the book by Doris Kearns Goodwin.

He was nominated for nine Emmys, most recently for outstanding guest actor in a drama series for FX's Rescue Me.

Durning served as a regular on the?Linda Bloodworth-Thomason sitcom Evening Shade, having previously played with that series' star, Burt Reynolds, in the films Starting Over (1979) and Best Little Whorehouse. The show ran 1990-94 on CBS. He also did voice work for Family Guy and had a recurring role as a priest on Everybody Loves Raymond.

Resembling what one might envision as a grizzled cop, Durning excelled in congenial everyman roles and was a familiar character actor, if not a household name. With his stocky frame, he played Santa Claus five times in TV movies, often invigorating the ?ho-ho? hum character with a curt edge.

He had a role in?Scavenger Killers, a crime thriller scheduled to open next year starring Eric Roberts?and?Robert Loggia.

The second youngest of five children,?Durning was born Feb. 28, 1923, in Highland Falls, N.Y. The son of an Army officer, he took classical dance lessons as a youth. Following high school, he served in the Army?s 1st Infantry Division during World War II. Durning took part in the Normandy invasion of France on?D-Day, winning the Silver Star, the Bronze Star and three Purple Hearts.

After his military discharge, he held several jobs: elevator operator, ironworker, cab driver, dance instructor, boxer. He fought on the same card as another future actor, Jack Warden, in New York's Madison Square Garden.?

While working as an usher in a burlesque joint, Durning was hired to replace a drunken actor onstage. He plowed into his new calling, performing in roughly 50 Brooklyn stock company productions and in various off-Broadway plays.

He attracted the attention of Joseph Papp: Beginning in 1962, Durning appeared in 35 plays as part of the New York Shakespeare Festival. During this period, he segued into TV, notching a stint as a police chief on the NBC soap opera Another World.

Durning made his film debut in 1965, playing in Harvey Middleman, Fireman. He also appeared in Brian De Palma?s Hi, Mom! (1971), credited as Charles Durnham.

In 1972, director George Roy Hill, impressed by his performance in the Tony Award- and Pulitzer Prize-winning That Championship Season, offered Durning a role in The Sting. In the Oscar best picture winner starring Paul Newman and Robert Redford, Durning won distinction as a crooked cop.

His other film credits include Dick Tracy (1990) and V.I. Warshawski (1991).

On TV, Durning brought a beatific countenance to a number of exalted roles, including playing the pope in the 1987 telefilm I Would be Called John: Pope John XXIII. He starred as the title officer in the 1975-76 series The Cop and the Kid, played the title character?s dad in the 1979 miniseries Studs Lonigan and was a private eye in the 1985 series Eye to Eye.

Durning also shined as a domineering industrialist in the 1989 telefilm Dinner at Eight, a role made famous by Wallace Beery in the 1933 film. He starred as a postman opposite lonely widow Maureen Stapleton in the wonderful Queen of the Stardust Ballroom in 1975 and played a baseball legend in 1981's Casey Stengel.

Among Durning's many other acclaimed Broadway performances were as Weller Martin in The Gin Game opposite Julie Harris, as Matthew Harrison Brady in Inherit the Wind with George C. Scott and as ex-President Arthur Hockstader in Gore Vidal?s The Best Man.

In 2008, the Screen Actors Guild gave Durning its Life Achievement Award, and he was honored with a star on the Hollywood Walk of Fame, right next to one for his idol, James Cagney.

Survivors include his daughters Michele and Jeanine and a son, Douglas, all of New York.?A private family service will be held and burial will be at Arlington National Cemetery.

The family invites friends and family to contribute to the Wounded Warrior Project, whose mission is to raise awareness and enlist the public's aid for the needs of injured service members; to help injured service members aid and assist each other; and to provide programs and services to meet the needs of injured service members. Durning was a regular supporter.

Russian parliament approves ban on American adoptions

MOSCOW (Reuters) - A bill banning Americans from adopting Russian children went to President Vladimir Putin for his signature on Wednesday after winning final approval from parliament in retaliation for a U.S. law that targets Russian human rights abusers.

Putin has strongly hinted he will sign the bill, which would also outlaw some U.S.-funded non-governmental groups and impose visa bans and asset freezes on Americans accused of violating the rights of Russians.

The Federation Council, Russia's upper house of parliament, voted unanimously to approve the bill, which has clouded U.S.-Russia relations and outraged Russian liberals who say lawmakers are playing a political game with the lives of children.

U.S.-Russia ties are already strained over issues ranging from Syria to the Kremlin's treatment of opponents and restrictions imposed on civil society groups since Putin, in power since 2000, began a new six-year term in May.

The bill has also drawn unusual criticism from senior government officials including Foreign Minister Sergei Lavrov and Olga Golodets, a deputy prime minister who warned the Kremlin that it may violate an international convention on children's rights.

Lavrov said last week that the ban would be "wrong", and that Russia should stand by a long-awaited bilateral accord that improves its ability to keep tabs on children adopted by Americans, which entered into force on November 1.

But Lavrov appears to have backed down. Foreign Ministry officials said on Wednesday that the bill would not violate the 1989 Convention on the Rights of the Child, and Russia would take steps to halt the bilateral agreement.

Putin has described the bill as an emotional but appropriate response to U.S. legislation he said was poisoning relations.

U.S. President Barack Obama this month signed off on the Magnitsky Act, which imposes visa bans and asset freezes on Russians accused of human rights violations, including those linked to the death in custody of an anti-graft lawyer in 2009.

The ban on American adoptions takes Russia's response a step further, playing on deep sensitivity among Russians - and the government in particular - about adoptions by foreigners, which skyrocketed after the 1991 Soviet collapse.

MORAL ARGUMENTS

The bill is named after Dima Yakovlev, a Russian-born toddler who died of a heat stroke when his adoptive American father forgot him in a car. He is one of 19 Russian-born children Moscow says have died "at the hands of U.S. citizens" in a decade, in cases that have been prominently featured in Russian state media.

In a poll conducted on December 23 by the Moscow-based Public Opinion Foundation, 75 percent of respondents said Russia should ban or place additional restrictions on foreign adoptions.

"It is immoral to send our children abroad to any country," Valery Shtyrov, a Federation Council deputy, said in a one-sided debate peppered with hawkish rhetoric before the 143-0 vote.

Children's rights advocates say the law, due to take effect on January 1 if signed by Putin, will deprive children of a way out of Russia's overcrowded orphanage system.

"This is the most vile law passed since Putin came to power," opposition activist Boris Nemtsov said, saying he was certain the president would sign it. "Putin is taking children hostage, like a terrorist".

Police said they had arrested seven people protesting against the law on Wednesday outside the Federation Council.

Nevertheless, lawmaker Gennady Makin said the Magnitsky Act demanded a tough response.

"He who comes to Russia with a sword dies by that sword," he said.

The Russian bill would outlaw U.S.-funded "non-profit organizations that engage in political activity", which Putin accuses of trying to influence Russian politics.

Russia ejected the United States Agency for International Development (USAID), which funds Russian non-governmental groups, in October, and Putin has signed a law forcing many foreign-funded organizations to register as "foreign agents" - a term that evokes the Cold War.

Americans affected by the visa ban could include those involved in the prosecution of Viktor Bout, a Russian arms dealer serving a 25-year prison term in the United States after an arrest and trial condemned as unfair by Moscow.

EPA report on chemicals, kids is sidetracked

A landmark Environmental Protection Agency report concluding that children exposed to toxic substances can develop learning disabilities, asthma and other health problems has been sidetracked indefinitely amid fierce opposition from the chemical industry.

America?s Children and the Environment, Third Edition, is a sobering analysis of the way in which pollutants build up in children?s developing bodies and the damage they can inflict.??

The report is unpublished, but was posted on EPA?s website in draft form in March 2011, marked ?Do not Quote or Cite.??The report, which is fiercely contested by the chemical industry, was referred to the White House Office of Management and Budget (OMB), where it still languishes.


For the first time since the ACE series began in 2000, the draft cites extensive research linking common chemical pollutants to brain damage and nervous system disorders in fetuses and children.

It also raises troubling questions about the degree to which children are exposed to hazardous chemicals in air, drinking water and food, as well exposures in their indoor environments ? including schools and day-care centers ? and through contaminated lands. ?

?

In the making since 2008, the ACE report is based on peer-reviewed research and databases from federal agencies, including the Food and Drug Administration, Housing and Urban Development and the Centers for Disease Control and Prevention.

Public health officials view it as a source of one-stop shopping for the best information on what children and women of childbearing age are exposed to, how much of it remains in their bodies and what the health effects might be. Among the ?health outcomes? listed as related to environmental exposures are childhood cancer, obesity, neurological disorders, respiratory problems and low birth weight. ?

The report cites hundreds of studies -- both human, epidemiological studies that show a correlation between exposure to certain chemical pollutants and negative health outcomes, and animal studies that demonstrate cause and effect. ?In some cases, the authors note, certain chemicals have been detected in children, but not enough is known about their effects to draw conclusions about safety.

In a section on perfluorochemicals (PFCs), for example, which are used to make nonstick coatings, and protect textiles and carpets from water, grease and soil, among other things, the draft notes that they are found in human breast milk.?

The report said that ?a growing number of human health studies? have found an association between prenatal exposure to PFCs and low birth weight, decreased head circumference and low birth length. It also stated that based on ?emerging evidence suggests that exposure to some PFCs can have negative impacts on human thyroid function.?

Furthermore, it noted that animal studies produced similar results, although exposures were typically at higher levels than people are exposed to.?

The EPA?s website still notes that the report will be published by the end of 2011. ?But after a public comment period that was marked by unusually harsh criticism from industry, additional peer review and input from other agencies, the report landed at OMB last March, where it has remained. No federal rule requires the OMB to review such a report before publication, but EPA spokeswoman Julia Valentine said the agency referred it to the OMB because its impact cuts across several federal agencies.

The spokeswoman said EPA had no idea when OMB would release it, allowing publication.?

A spokeswoman for the White House Office of Management and Budget said she would not discuss the review process or give an estimated release date. ??

Some present and former EPA staffers, who asked not to be named for fear of losing their jobs, blamed the sidetracking of the report on heightened political pressure during the campaign season.? The OMB has been slow to approve environmental regulations and other EPA reports throughout the Obama Administration ? as it was under George W. Bush according to reports by the Center for Progressive Reform, a nonprofit consortium of scholars, doing research on health, safety and environmental issues, which generally advocate for stronger regulation and better enforcement of existing law.

?Why is it taking so long? One must ask the question,? said a former EPA researcher who works on children?s health issues. ?It is an important document and it strikes me that it?s falling victim to politics.???

The EPA states that the report is intended, in part, to help policymakers identify and evaluate ways to minimize environmental impacts on children.

That?s an unwelcome prospect to the $674 billion chemical?industry, which stands to lose business and face greater legal liability if the EPA or Congress bans certain substances mentioned in the report or sets standards reducing the levels of exposure that is considered safe.

Among other findings, the report links numerous substances to ADHD, including certain widely available pesticides; polychlorinated biphenyls? (PCBS), which were banned in 1979 but are still present in products made before then and in the environment; certain polybrominated diphenyl ethers (PBDEs), used as flame retardants; and methyl mercury, a toxic metal that accumulates in larger fish, such as tuna.? The draft also cites children?s exposure to lead, particularly from aging lead water pipes, as a continuing problem (See previous coverage, Toxic Taps.)?

Among the other widespread contaminants linked to learning disabilities is perchlorate, a component of rocket fuel , fireworks and other industrial products, which has polluted water around the country.? The Department of Defense, which wants to avoid paying to clean it up, is alarmed by research showing that the chemical interferes with thyroid function and otherwise damages the nervous system, according to R. Thomas Zoeller, a biology professor at the University of Massachusetts Amherst, and an expert on perchlorate.

Zoeller, who has served on EPA advisory panels studying the issue, said the Pentagon?s concern was evidenced by the Air Force?s hiring of two consultants ? Richard Mavis and John DeSesso --? to help shape its response to the research. ?He noted that in 2009, after their consulting contract had ended, Mavis and DeSesso wrote a letter to the editor of Environmental Health Perspectives, a publication of the National Institute of Environmental Health Sciences, attacking an EPA scientist?s study showing that perchlorate may damage the brain. ??I don?t like my tax dollars going for one federal agency to refute the work done by scientists at EPA,? ?he said. The Defense Department and the Air Force declined to comment on the publication, but spokeswoman? Melinda Morgan wrote that, ?The DoD is aware that there are many differing opinions on the science related to perchlorate health effects,? and believes the current level permitted by EPA is safe.

One of the new sections of the report notes that children may be widely exposed to pollutants in schools and day-care centers. Among them are pesticides; lead; PCBs; asbestos, a mineral fiber long used as insulation and fire-proofing;? phthalates, chemicals that are used to soften vinyl and as solvents and fixers, and are found in numerous consumer goods, among them: toys, perfumes, medical devices, shower curtains and detergents; and perfluorinated chemicals, which are used in non-stick and stain-proof products. ?The study notes that these substances are (variously) associated with asthma, cancer, reproductive toxicity and hormone disruption.?

The American Chemistry Council (ACC) , the chief industry trade group, has accused EPA of lacking objectivity and vilifying its products. It has filed dozens of pages of comments accusing the EPA of ignoring certain studies ? including some funded by ACC itself ? that would help businesses make the case that their products are safe. The ACC also contends that EPA has not included enough positive comments about the role of chemicals in society. ??

?ACC members apply the science of chemistry to make innovative products and services that make people?s lives better, healthier and safer,? wrote ACC senior toxicologist Richard A. Becker. ? ?The exclusive focus on exposure is particularly problematic as it may lead to the incorrect conclusion that exposure to chemicals (e.g. phthalates) at any level is not only cause for concern, but also a direct source of negative health effects.?

Becker also expressed the ACC?s contention that EPA was painting too bleak a picture of children?s health in America.??

?It is troubling that the draft ACE report seems to make such little effort to provide a complete overall picture of child health in the United States,? Becker wrote. ?For example, the draft report does not refer to The Health and Well-Being of Children: A Portrait of States and the Nation ? which concludes the health and well-being of children in the U.S. is improving overall with 84.4% of children in the United States listed as being in excellent or very good health, an increase from 83% in 2003.? Other ACC members, representing manufacturers of BPA, phthalates and other substances, also weighed in against the report.

Nsedu Witherspoon, executive director of the Children?s Environmental Health Network and a member of the EPA Children?s Health Protection Advisory Committee, which oversaw the report, called it a major accomplishment, reflecting the explosion of science since the first ACE was published. She also praised EPA chief Lisa Jackson for standing behind it.

Industry critics, Witherspoon said, ?in many cases are the same ones out there trying to debunk the original research,? that the study cites. ?

Rena Steinzor, a professor at the University of Maryland School of Law, and president of the Center for Progressive Reform, said the ACE report need not have gone to OMB for review in the first place. Steinzor notes that Executive Order 12866 states that proposed significant regulations ? generally defined as those that could cost more than $100 million ? need be reviewed by OMB, but studies do not. ?

The Executive Order gives OMB up to 60 days to review such proposals ? although it allows for extensions. In practice, OMB has missed numerous such deadlines.?But the ACE report, which is not a proposed regulation, falls into a gray area.

?If it?s not a rule, I don?t know what it?s doing there,? Steinzor said. ?And even if it were a rule, there would be a deadline and they?d be violating it.?

In an email statement to the Investigative Reporting Workshop, EPA spokeswoman Julia Valentine said, ?The report was provided to OMB so that they could conduct an interagency review process to ensure accuracy and consistency.?

She noted that because the report addresses children's health, it includes issues that are the focus of many departments and agencies within the Department of Health and Human Services -- including the Centers for Disease Control, the Food and Drug Administration, the National Institute of Environmental Health Sciences and the National Cancer Institute. ??

Steinzor, whose organization has studied OMB under numerous presidents, doesn?t buy it.?

The report should be released now, she said, ? because to protect children adequately we need all the information we can get? I guess I understand why there was great anxiety and paranoia before the election ? (but) why would you not do it now? It?s sad that things have gotten so polarized that we?re afraid to release scientific information.?

Syria activists: Assad's forces use 'poisonous gases'

CAIRO -- Several Syrians have died after inhaling poisonous gas released by government forces in rebel-held districts of Homs, local eyewitnesses and activists claimed Monday.

Civilians were admitted to hospital with serious breathing problems after Sunday?s attack, according to doctors and groups who posted what they said was video of the aftermath to YouTube.

The gas is thought to have been a concentrated irritant, but not one of the deadly chemical weapons stockpiled by the regime of Syria president Bashar Assad.

Claims by either side in Syria?s bitter civil war are almost impossible to independently verify because journalists are rarely allowed access to the country.

Pesticide poisoning?
Mousab Azzawi, chairman of the London-based Syrian Network for Human Rights and a doctor, told NBC News that his organization had received reports from three eyewitnesses on Sunday.

He said field doctors in Homs were seeing patients ?losing consciousness, experiencing severe shortness of breath and vomiting.?

?To our understanding, this is similar to poisoning with pesticide,? he said, although he was not aware of any pesticide that could take the form of a gas.

Azzawi added that they were ?very concerned and deeply worried? that the attack might be a sign that Assad?s regime might use chemical weapons ?on a very small scale.?

Walid Fares, spokesman for the Homs Revolutionary Council -- part of the National Coalition for Syrian Revolutionary and Opposition Forces, the umbrella organization recognized by more than 100 countries including the United States -- issued a statement to NBC News on Monday.

It said ?poisonous gases? came from shells fired by government tanks in the districts of Al Bayada and Al Khalideya.

?The shells did not explode but rather emitted a cloud of white smoke and it landed in residential areas? where revolutionaries had gathered and which led to tens being injured,? the statement said.

It said symptoms included ?complete absence of vision? as well as nausea, lost consciousness and severe breathing difficulty.

?The initial analysis of the doctors in the hospital confirmed that it is a poisonous gas that contains banned substances,? the statement added, citing videos that claimed to show patients being treated.

'This isn't the first time'
It said there were seven deaths as of early Monday - naming six of the victims - and close to 50 injured.

A third group, the Local Coordination Committees - a network of local opposition councils across Syria - told NBC News: "The LCC has not yet confirmed what the substance was, but doctors in Homs are confirming the use of toxic gases. This isn't the first time; residents of Homs and Zabadani were reporting the use (confirmed) of white phosphorus months ago.?

Two YouTube videos showed patients being treated in hospital for the symptoms of a gas attack. In one, a doctor says in Arabic that the gas is ?definitely not Sarin? but is ?definitely? poisonous.

US officials:?Syria loads chemical weapons into bombs; military awaits Assad's order

Earlier this month, President Barack Obama warned Assad that the use of chemical weapons by his regime would be "totally unacceptable." "If you make the tragic mistake of using these weapons there will be consequences and you will be held accountable," he said.

The alleged gas attack came hours after a senior Israeli defense official said he believed Syria's chemical weapons were still secure despite the civil war.

Amos Gilad told Army Radio that the both sides had become deadlocked but there was no sign of Assad heeding international calls to step down, according to a Reuters report.

"Suppose he does leave, there could be chaos ... in the Middle East you never know who will come instead. We need to stay level-headed; the entire world is dealing with this. At the moment, chemical weapons are under control," Gilad said.
